Refund Policy

This Cancellation and Refund Policy defines the terms governing financial adjustments, cancellations, and refund eligibility for corporate clients using the platform and services provided by Benchil ("the Agency").

1. Benchil Talent Pool Subscriptions (Strictly Non-Refundable)

  • Upfront Billing: Recurring monthly fees required to access the pre-vetted Benchil Talent Pool are processed upfront on the first day of each billing cycle.
  • No Retrospective Refunds: Subscription fees are paid to secure ongoing platform access, search functionality, and candidate data viewing privileges. No full, partial, or pro-rated refunds will be issued for unused time, partial months, or a failure to successfully select or hire a candidate during a billing cycle.
  • Cancellation Notice: Clients may cancel their subscription at any time via their account dashboard or by emailing our billing team. Cancellation requests must be submitted at least [e.g., 7] days prior to the next scheduled renewal date to prevent auto-billing. Following cancellation, access remains live until the end of the paid cycle.

2. Contract Staffing and Hourly Billing Adjustments

Because contract staffing is billed on an hourly consumption basis for hours actually worked, standard refunds do not apply. However, billing adjustments are handled under the following strict conditions:

  • Trial / Initial Satisfaction Window: If a contract professional deployed from our pool fails to meet the basic technical competencies outlined in the Work Order, the Client must submit a formal complaint within the first [e.g., 40 hours or 5 business days] of deployment.
  • Billing Waivers: Upon verified immediate removal of the underperforming contract professional within this window, the Agency will waive the hourly bill charges for those initial days and prioritize a replacement resource.
  • Timesheet Approvals: Once a Client reviews and approves a candidate’s weekly timesheet, those hours are locked. Approved hours are considered definitive confirmation of satisfactory service, and no billing adjustments, disputes, or chargebacks will be entertained retroactively.

3. Permanent Placement Guarantees (No Cash Refunds)

  • Traditional direct-hire permanent placement fees are non-refundable once the candidate initiates employment.
  • Replacement Remedy: In alignment with Section 7 of our Master Terms & Conditions, if a permanent candidate leaves within their 90-day probationary period, the sole remedy provided is a free candidate replacement search. Cash refunds are not provided for early exits or role liquidations.

4. Subscription Fee Disputes

If you believe an incorrect charge has been processed against your account, you must contact our billing department at hello@benchil.com within 30 days of the transaction date. The Agency will review the system logs and correct any clear technical billing errors promptly.
